Every line links to its statute. Checked Sep 18, 2026.
- Who can authorize a cremation
- Texas sets out a detailed priority list for control of a decedent's remains. A person designated in writing by the decedent comes first, followed by the surviving spouse, adult children, parents, adult siblings, the qualified estate representative, and then other kin in the statutory order. Texas provides that a person who has the right to control disposition can lose that right if they do not make final arrangements or appoint someone to do so before the earlier of the sixth day after receiving notice of death or the tenth day after death. statute →

Why these numbers are comparable
A price list is a list of line items, and no two homes itemize the same way. We rebuild the same basket at every home. Medians across the 20 homes with a checked price list:
- Immediate burial (casket provided by purchaser)
- $4,170
- Basket, median items
- $4,170
Anything a home charges outside this basket is shown on its own page, not hidden in the comparison.

Questions families ask
Answers use the figures on this page, not national averages.
Among 20 funeral homes serving Houston with a checked price list, immediate burial runs from $2,300 to $8,075, with a median of $4,170. The middle half of these homes charge between $3,528 and $5,415. Each figure comes from that funeral home's own General Price List, and we checked it against that list; the oldest check was Oct 7, 2026 and the most recent was Oct 12, 2026. We list 74 funeral homes serving Houston, and 20 of them have a price list we've checked so far.
The total adds these items from each funeral home's price list: immediate burial (casket provided by purchaser). Cemetery or crematory fees charged by third parties, death certificates, and merchandise such as an urn or casket are extra unless a funeral home lists them.
No. Under the federal Funeral Rule (16 CFR Part 453) you have the right to choose only the goods and services you want, and every funeral home must give you an itemized General Price List. The packages here are a comparison aid built from those itemized prices, not something the funeral home sells as a bundle.
The biggest differences are the non-declinable basic services fee, whether the funeral home has its own crematory or uses a third party, and how far it will travel to collect the deceased before a mileage charge applies. Each funeral home's page shows all of these.
