The terms that govern your use of HonestFarewell, a death-care price-transparency and comparison platform operated by Honest Reviews Tech LLC (HonestReviews).

These Terms of Use ("Terms") govern your access to and use of HonestFarewell, operated by Honest Reviews Tech LLC, a Delaware limited liability company ("HonestReviews").

By accessing or using https://honestfarewell.org, you agree to these Terms.

If you do not agree to these Terms, do not use the Site.

1. About HonestFarewell

HonestFarewell is a consumer-facing death-care price-transparency, comparison, review, and information platform.

The Site may provide:

  • funeral-home and cremation-provider information;
  • cemetery and memorial-service information;
  • pricing information and comparisons;
  • General Price List and other publicly available pricing information;
  • consumer reviews and ratings;
  • educational articles and guides;
  • search and comparison tools;
  • links to third-party providers;
  • affiliate or referral opportunities; and
  • other death-care resources.

HonestFarewell is not itself a funeral home, crematory, cemetery, insurer, law firm, medical provider, or government agency unless expressly identified otherwise on the relevant page.

2. Informational and Comparison Service

The Site is intended to help consumers research and compare options.

Information presented on HonestFarewell may come from:

  • public records;
  • government or regulatory sources;
  • funeral-home or provider websites;
  • General Price Lists;
  • provider-submitted information;
  • third-party data sources;
  • user submissions and reviews;
  • automated data collection; and
  • other sources.

We make reasonable efforts to maintain useful and accurate information, but information can change without notice.

You should independently confirm current prices, availability, licensing, services, restrictions, and contractual terms directly with the relevant provider before making a purchase or arrangement.

3. No Guarantee of Accuracy

HonestFarewell does not guarantee that information on the Site is:

  • complete;
  • current;
  • error-free;
  • available in every location;
  • applicable to your particular circumstances; or
  • representative of the current price or terms offered by a provider.

Prices may exclude taxes, permits, transportation, merchandise, cemetery charges, death certificates, optional services, location-specific fees, or other charges.

A comparison on HonestFarewell should not be treated as a quote, contract, or binding offer from a provider.

4. Consumer Choice and Contact

The Site is designed so that consumers can access core information without paying HonestFarewell merely to view a comparison.

Where the Site provides a "Contact," "Request Information," "Get Quote," "Call," "Visit Website," or similar action, you may choose whether to initiate contact.

Submitting information through a third-party form or clicking through to a provider may create a direct relationship between you and that third party.

HonestFarewell does not guarantee that a third-party provider will respond, offer the displayed price, or provide any particular product or service.

5. Third-Party Providers

HonestFarewell may list or link to third-party businesses and service providers.

Those providers are independent businesses.

Unless expressly stated otherwise:

  • we do not employ their personnel;
  • we do not control their services;
  • we do not guarantee their performance;
  • we do not guarantee their licensing or regulatory compliance beyond information we expressly identify as verified;
  • we are not a party to your agreement with them; and
  • disputes concerning their products or services should generally be addressed directly with them.

If you purchase services from a third party, that transaction is between you and the third party.

6. Reviews, Ratings, and User Content

HonestFarewell may permit users to submit reviews, ratings, comments, photographs, questions, responses, and other content.

You represent that:

  • you have the right to submit the content;
  • your content is not knowingly false or misleading;
  • your content does not unlawfully impersonate another person;
  • your content does not infringe another person's intellectual-property or privacy rights;
  • your content does not contain confidential information you are not authorized to disclose;
  • your content does not contain malicious code; and
  • your content complies with applicable law and these Terms.

We may remove or decline to publish content that we reasonably believe violates these Terms, applicable law, or the integrity of the review system.

7. Review Integrity

To protect consumers and providers, HonestFarewell may use reasonable measures to identify or investigate:

  • spam;
  • duplicate reviews;
  • fraudulent reviews;
  • coordinated manipulation;
  • undisclosed conflicts of interest;
  • impersonation;
  • abusive content; and
  • other activity that compromises review integrity.

We may request additional information from a reviewer where reasonably necessary to verify authenticity.

We do not guarantee that every review is authentic or that every fraudulent review will be detected.

8. License to User Content

By submitting User Content to HonestFarewell, you grant HonestReviews a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, reproduce, display, publish, distribute, format, translate, adapt, and otherwise use that User Content in connection with operating, promoting, improving, and developing HonestFarewell and related services.

This license continues for as long as reasonably necessary for those purposes, subject to applicable law and our Privacy Policy.

You retain ownership of your User Content.

We may display your chosen username, review, rating, or other information you elect to publish.

9. Prohibited Conduct

You may not use the Site to:

  • violate any applicable law or regulation;
  • submit knowingly false or fraudulent information;
  • manipulate ratings or reviews;
  • post reviews in exchange for undisclosed compensation;
  • impersonate another person or business;
  • harass, threaten, defame, or abuse another person;
  • publish private or confidential information without authorization;
  • upload malware, viruses, or malicious code;
  • scrape, crawl, harvest, or systematically extract Site content except as expressly permitted by us or applicable law;
  • interfere with the security or operation of the Site;
  • attempt to gain unauthorized access to accounts or systems;
  • use the Site to send unsolicited commercial communications;
  • reverse engineer or circumvent technical restrictions;
  • use automated systems in a manner that places an unreasonable burden on the Site;
  • infringe intellectual-property rights; or
  • use the Site for a purpose that is inconsistent with these Terms.

10. Provider and Business Accounts

If HonestFarewell offers business, provider, claimed-listing, advertising, or other professional accounts, additional terms may apply.

Businesses may not use access to HonestFarewell to manipulate reviews, suppress legitimate consumer feedback, misrepresent pricing, or otherwise interfere with the integrity of the platform.

HonestFarewell may suspend or terminate provider access where necessary to protect consumers, the platform, or the integrity of its information.

11. Pricing and Sponsored Placement

HonestFarewell may receive compensation from third parties through advertising, affiliate arrangements, referrals, click-outs, sponsorships, or consumer-requested connections.

Compensation may influence the placement, visibility, or availability of certain commercial opportunities, but does not necessarily mean that a provider is the cheapest, highest-rated, or most suitable option.

Where appropriate, sponsored or commercial content may be labeled.

Unless expressly stated otherwise, a provider's presence on the Site should not be interpreted as an endorsement or guarantee by HonestReviews.

HonestFarewell may provide educational information or links concerning insurance, legal services, estate planning, probate, or other related services.

Such information is general and informational.

Nothing on the Site constitutes legal, insurance, tax, financial, or professional advice.

Where HonestFarewell facilitates a connection with a lawyer, insurer, or other professional, the relationship is between you and that professional.

Any referral, advertising, affiliate, or commercial relationship is subject to applicable law and any required disclosures.

13. No Professional Advice

The Site does not provide:

14. Emergency and Immediate-Need Situations

HonestFarewell is not an emergency service.

If a death or medical emergency has just occurred, follow the instructions of the appropriate emergency, medical, hospice, law-enforcement, or governmental authority.

Do not rely on HonestFarewell for emergency response, authorization to release remains, transportation of a decedent, medical decisions, or legal determinations.

15. Intellectual Property

The Site, including its software, design, branding, text, graphics, databases, compilation, layout, logos, trademarks, and other original content, is owned by or licensed to HonestReviews and is protected by applicable intellectual-property laws.

Subject to these Terms, HonestReviews grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes.

You may not:

  • copy substantial portions of the Site;
  • reproduce or republish Site content for commercial purposes;
  • create derivative databases or directories;
  • sell Site content;
  • use HonestFarewell branding without permission; or
  • remove proprietary notices.

Nothing in these Terms transfers ownership of any HonestReviews or HonestFarewell intellectual property to you.

16. Data and Directory Information

HonestFarewell may compile information from public and third-party sources.

The compilation, organization, normalization, presentation, and structure of information on the Site may constitute proprietary work even where individual underlying facts are publicly available.

You may not systematically reproduce the Site's database or use automated means to create a competing database without authorization.

The Site may contain links to third-party websites and services.

A link does not necessarily constitute an endorsement.

We are not responsible for third-party content, availability, pricing, privacy practices, security, terms, or services.

Your use of third-party websites is at your own risk.

18. Availability and Changes to the Site

We may modify, suspend, discontinue, or restrict any part of the Site at any time.

We may change, add, or remove features, providers, content, comparison methods, or other functionality.

We do not guarantee uninterrupted availability or that the Site will be free of errors or security vulnerabilities.

19. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

HONESTREVIEWS DISCLAIMS WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RELIABILITY.

WE DO NOT WARRANT THAT THE SITE OR ITS CONTENT WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

NOTHING IN THESE TERMS DISCLAIMS A WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE DISCLAIMED.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HONESTREVIEWS, HONESTFAREWELL, AND THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR ANY THIRD-PARTY SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF HONESTREVIEWS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO HONESTREVIEWS FOR THE RELEVANT SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100.

These limitations do not apply where prohibited by law.

21. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless HonestReviews, HonestFarewell, and their affiliates, officers, directors, employees, contractors, and service providers from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from:

  • your violation of these Terms;
  • your User Content;
  • your violation of applicable law;
  • your infringement of another person's rights; or
  • your misuse of the Site.

We reserve the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with that defense.

22. Dispute Resolution

Before filing a legal claim relating to the Site or these Terms, the parties should make a good-faith effort to resolve the dispute informally.

Nothing in these Terms limits rights or remedies that cannot lawfully be limited, including rights under applicable consumer-protection laws.

23. Termination

We may suspend or terminate your access to the Site if we reasonably believe you have violated these Terms, applicable law, or the integrity or security of the Site.

You may stop using the Site at any time.

Sections that by their nature should survive termination will survive, including provisions concerning intellectual property, User Content, disclaimers, limitations of liability, indemnification, and dispute resolution.

24. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will update the Last Updated date above.

If a material change requires additional notice under applicable law, we will provide that notice through the Site or another appropriate method.

Your continued use of the Site after the updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.

25. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.

26. No Waiver

A failure by HonestReviews to enforce a provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.

27. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms expressly incorporated by reference, constitute the agreement governing your use of HonestFarewell, except where a separate written agreement expressly governs a particular service.
